WebAssist Solutions - EULA Update

  On March 17th 2010, WebAssist has made a change to our End User License Agreement so that each license of a solution can only be deployed to one website for one client. This is in response to feedback to help protect developers using our extensions from competing with our pre-built solutions while allowing us to continue to provide affordable solutions to those customers who need them. This move will also let us continue to invest across our entire product line to support both our developers and growing small business owner market. Our new licensing does not affect customers who have previously purchased a solution from us but will be applied to any new releases or updates.  



Will look forward to seeing the new price list for solutions. The current price of the Contact Form Solution Pack is $29.99, but is probably more accurately worth around $9.99. If it is to be licensed for a one-time deployment then - at a stretch - it will hopefully be selling for $2.99.

I think I agree with you on this.

My issue with this new EULA is if it is to "protect" developers, than I would say that anyone who is member of extension library subscription and buys the solutions should always have a developer license - even on new solutions (not just the old ones).

This new EULA doesn't as much protect me as a developer as it does prohibit me from using the WA solutions as an option in my arsenal of tools to deploy because the value of having to buy the same solution over and over would diminish the value of it altogether. Not only that, it still wouldn't combat the issue developers have with would-be client's who will buy it for a "one-off" solution. Remember, the one-off clients don't use these solutions the same way as developer would.

My honest thought is that the EULA will just impede developers from using the solutions - not protect them.

Don't get me wrong... I am a huge supporter of WebAssist and I think the WA team has great intentions and creates great products, but I do feel this EULA is, perhaps, misguided at best.

This makes it clear that WA has moved developers from the previous position of primary customers, to primary competitors of WA. At least developers know where they stand now.

I am also a supporter of WebAssist, and (apart from pointing out that CSSFormBuilder is one of the direst pieces of software ever built) have remained loyal to the brand, - I have never touted another company's products to visitors to the forum. This was in some small part due to the nature of the licensing of the solutions which gave them repeat-use value.

It is going to be very difficult to recommend some solutions under the revised licensing scheme. I don't use Contact Form Solution Pack simply because it doesn't do very much, but I could see that being able to use it time and time again gave it some value. But at $29.99 it's already poor value (even for multiple sites) if you compare it with some other products. If you continue with this, I already have two of the solutions covered by better (unlimited use) alternatives, and another one covered by a better and cheaper per site alternative. Incidentally, one of the alternative solutions I referred to earlier (I won't say which one it is) has the most sophisticated image uploading, editing and organising management system (multiple galleries, multiple albums, multiple users (either Admin or Editor status) + loads of features) and can be implemented for around $70. (PowerGallery regular price $99.99) Oh yes, and it does video galleries too.

Hey neilo,

You just need to think outside the box and change your client terms to match the new terms for the developer. Change all of your Submit buttons to PayPal Buy Now buttons. Put a message on the forms explaining the new Developer's Tax and the amount of the fee for using the form.

You should be able to recover your investment in no time, as long as your client's visitors go along with the new terms of use. Don't forget to change the WULA (Website User's License Agreement) to cover the new charges.

BTW, thanks for the reminder of the other solution. I forgot I had that.

This doesn't sit well with me. Tell me if I'm wrong, but this is the 3rd time this thing has been changed? This new license agreement isn't for the solutions I've already purchased, but just on upgrades. Will I upgrade to have this new license agreement? No.

I do not understand this new license, but it pretty well makes me angry this is in place. How is it suppose to "Protect the developer?" Developers buy these solutions to make their job easier.

This new "license" is just as dirty as the one you guys tried to put in place before people got angry over it. The license before the current new one was perfect. Why fix something when it really isn't broke? Leave it alone.

So what's the real reason this license is changing, because protecting the developer is crap excuse.

Also, Thanks for letting us know about that unnameable contact form. I found it and will more than likely be purchasing it.

Devastated

I have just spent 2 years and $1000.00+ on WebAssist extensions & learning web development for a new business enterprise.
I spent this money in good faith... that I might use the products to develop sites for customers at some time in the future.
My frustration had always been the lack of support for PayPal Canada which is now apparently supported by eCart 5.
Do I understand correctly that if I upgrade any of my products (the reason for my visit to the site today) that I will then loose the right to use it on more than one site?
I own almost everything in the entire library - now outdated.
Tell me I misunderstand. please.

As far as I know it only applies to "Solutions" so your extensions should be OK. What's troubling though is the sudden change in attitude towards customers and the uncertainty it brings.

This isn't really a sudden change. This is similar to the original license we used when solutions were first introduced. We changed it after listening to customer feedback, but unfortunately the new licence left room for abuse... we have now changed it back after consideration and consultation from our sales and legal team.

Hi Ray,

I totally respect that and believe there probably was some abuse, but my issue is that this actually hurts many of us developers who use the products the correct way. Is there not some way to still offer a developer license on solutions?

One idea would be to offer an add on to the Subscription Library. I would gladly pay, say, $250 per year instead of $200 in order to license the solutions as developer along with my other extensions.

Thoughts? I really feel strongly that the developers who really use WA products the right way should not be penalized because of the few abusers.
