Problem with nested menus

Im trying to do a dynamic menu with 3 nested menus items the script works ok if all nested values are there example

  1. Item1

    1. item2

      1. -Itemsub2

        1. -itemsub2.2
        2. -itemsub2.3


  2. item3



but if in the database there are still no nested records to be added im getting some error messages

Warning: mysql_free_result() expects parameter 1 to be resource, null given in C:\xampp\htdocs\site\CSSMenuWriter\cssmw0\menu.php on line 140  



Not all the time i might have submenus so if i have the 3 levels of submenus there are no error messages but if a level is missing then i get that error above, what can i do to fix it?
