ERROR Mail::factory() should not be called statically

this is a fairly new cart that was setup within the last few months. but now i am getting an error. i think something on the server must have changed because its an error referencing the pear mail file (which hasn't changed at all).

i am now running into an error that states:
Strict Standards: Non-static method Mail::factory() should not be called statically in /home/jillians/public_html/webassist/email/PEAR_Mail_using_SMTP_php.php on line 190

line 190 is this:
$theMailer =& Mail::factory('smtp', $paramArray);

i will send some PM info that will allow you to test and see it.

note that the emails still send out. but it doesnt forward to the THANK YOU page.
