The #top is not working which makes it appear that the delete is not working because it is not displaying unless you manually scroll to the top of the page.

You need to add an anchor named "top" to the top of the page for it to know where to go to.
Add this to the page at the top where the message is displayed:
<a name="top"> </a>
The styles needed to be adjusted to display the delete message in the proper place.
The solution was to update the css to use:
position:fixed;
instead of:
position:absolute;
That way the error shows over the page regardless of the scroll position.
I am having the same trouble on the page listed in the PM.
Update the classes on the page:
.messageContainer {
and
.black_overlay {
to include:
position: fixed;
instead of:
position: absolute;
and that should fix the problem.
