image file upload directory structure

Hi I'm having a strange problem I don't quite understand.
I have the upload directory for the image files set to "../images/products/"
During testing on my local machine it worked perfectly, it recognise the ../ and went up a directory as it should, but with the site online it's not working the same..

When I try to upload a picture I get :

Warning: move_uploaded_file() [function.move-uploaded-file]: Unable to move '/cust-web/h/d/E1111111/sites/www.testsite.com.au/tmp/phpeziVEh' to '/cust-web/h/d/E1111111/sites/www.testsite.com.au/html/testshop/admin/../images/products/36b27bed794f71c252f9b9515a46c599_tmp.jpg' in /cust-web/h/d/E1111111/sites/www.testsite.com.au/html/testshop/webassist/file_manipulation/helperphp.php on line 96

As you can see it is trying to upload to "/cust-web/h/d/E1111111/sites/www.testsite.com.au/html/testshop/admin/../images/products/"

It is counting the ../ as a directory called ".."

How can I get around this?

/cust-web/h/d/E1111111/sites/www.testsite.com.au/html/testshop/admin/../images/products/

is the equivalent of:
/cust-web/h/d/E1111111/sites/www.testsite.com.au/html/testshop/images/products/

the error is saying that the folder:
/html/testshop/images/products/

does not have the proper permissions to allow the uploaded image to be copied there.

double check the upload folder permissions to make sure they allow write access.

Ok, the directory has all permissions except public write access, does it need to have this?

depending on the host, the directory may need to have public write access, yes.
