DataAssist Search returning all

I have gone through the data assist search setup and it set up 2 pages, test_Search.php and test_Results.php... I renamed the results page to search.php and added the code from the test_rSearch.php page to my header include...

Two problems have come up around this.

1. even with the action set to search.php [method=get], from the include, the form doesn't navigate to the search.php page.
2. the search.php, if you navigate to it directly, returns all rows from the database, there is actually no way to return an empty recordset.

On a side note... The form works perfectly if I upload the test_Search.php and test_Result.php pages...

Is there something I'm missing? Can I not have the search form in an include?
