Thanks Brian for bringing that to our attention. Looks like something right out of the Microsoft EULA, which is why I'm still running XP.

Hopefully those that haven't made a purchase since March 17, 2010 will not be forced to submit to this.

I guess it's not enough to just avoid upgrading the Solutions. This applies to "Software, Solution, or Training.":

Section 6:

  You agree by your installation and use of this copy of the Software to voluntarily terminate your EULA with respect to such prior license and that you will not continue to install or use such prior license of the Software or transfer it to another person or entity.  

Well said:

  While I have no intention of violating any license agreement I also don't want vendors poking around on my machines where I have personal and client confidential information.  

Especially with the risk of picking up the tab if they get you with a technicality that you weren't aware of.

Looks like the ultimate deal-killer to me. I guess that rouge ISP has turned all the customers into evil software violators that must be controlled. Don't just just love it when lawyers get to make the rules?
