bug with DW CS4 template and HTML5?

I know that CS5.5 are better but now don't would like buy it, however I have resolved leaving the old html declaration until I use the template and replacing it with the html5 declaration when finished to build the site.
I know it is not very comfortable but I have not found other solutions for cs4
